If the animal is from a source that is licensed by the United States department of agriculture, the individual identifying tag, tattoo or color number for the animal shall be included. The breed, sex, color and other identifying marks apparent at the time of sale. The immunizations and deworming treatments that have been administered to the animal as of the time of sale, if known, including the dates of administration and the type and brand of vaccine or deworming treatment.ģ. The date of the animal's birth, if known, the state in which the animal was born, if known, and the date the pet dealer received the animal.Ģ. At the time of sale, each pet dealer shall give the purchaser of a cat or dog a written statement that contains the following information:ġ. If the pet dealer keeps the cat or dog, the pet dealer shall cage the cat or dog separately from healthy animals and shall house and handle the cat or dog in a manner that will minimize the likelihood of contagion.Ī. If the veterinarian determines that a cat or dog is afflicted with a contagious disease, the cat or dog may be returned to the source or kept by the pet dealer. A veterinarian who is licensed pursuant to title 32, chapter 21 shall examine all cats and dogs that are received by a pet dealer before the cat or dog is placed for sale.ī. "Purchaser" means a person who purchases any cat or dog without intent to resell.Ī. Pet store does not mean a publicly operated pound or a private, charitable not-for-profit humane society or any animal adoption activity that a pound or humane society conducts off site at any pet store or other commercial enterprise.ĥ. "Pet store" means a commercial establishment that engages in a for-profit business of selling at retail cats, dogs or other animals, but does not include commercial livestock operations and commercial livestock auction markets. "Pet dealer" means a person who owns a pet store.Ĥ. "Nonelective surgical procedure" means a surgical procedure that is necessary according to commonly accepted standards of veterinary medicine to preserve or restore the health of the cat or dog, to prevent the animal from experiencing pain or discomfort or to correct a condition that would interfere with the cat's or dog's ability to walk, run or jump or to otherwise function in a normal manner.ģ. "Clinically ill" means an illness that is apparent to a veterinarian based on the veterinarian's observation, examination or testing of an animal or on a review of the animal's medical records.Ģ. In this chapter, unless the context otherwise requires:ġ. Pet stores pet dealers prohibitions on dog and cat purchases recordkeeping Applicability to other laws waiver of rights Purchaser remedies for sale of unfit cats or dogs requirements exceptions Animal care requirements violation classification Information statement purchaser rights notice Purchasers have fifteen days to return unhealthy or diseased dogs and receive a refund or compensation for reasonable veterinary expenses. The section requires that retail pet sellers provide purchasers a notice of rights that includes a statement of good health signed by a veterinarian.
